Against all odds: Soemadipradja & Taher helps secure a win for PT Astra Honda Motor in a competition complaint initiated by KPPU

In a recent high-profile competition law case, Soemadipradja & Taher (S&T) successfully represented one of its clients, PT Astra Honda Motor (AHM), in competition investigations and litigation initiated by the Indonesian Competition Commission (Komisi Pengawas Persaingan Usaha, KPPU). On 25 February 2021, the KPPU Panel of Commissioners (Panel) rendered its decision in Case No.31/KPPU-I/2019 (the Prohibited Agreements Case), declaring AHM not guilty of violating the prohibition on business entities entering into illegal “tying” and “bundling” agreements. Such prohibitions are regulated under paragraphs (2) and (3) of Article 15 of Law No.5 of 1999 on the Prohibition of Monopolistic Practices and Unfair Business Competition (Competition Law).
